Antisocial Behaviour Orders (ASBO’s) are orders to protect the victims of antisocial behaviour and the wider community from any further acts of antisocial behaviour. ASBO’S were first introduced by the Crime and Disorder Act 1998, but were limited to people aged 16 years and over. As a result of the 2004 Act the application of ASBO’s has been extended to 12 year olds and older. They are also viewed as a preventative measure intended to modify behaviour that may escalate to the level of criminal behaviour. They will only be applied to persons for whom alternative options have not been effective in addressing their conduct and protecting the community. ASBO’s can be made against any person irrespective of their housing tenure i.e. owner-occupiers, private sector tenants and tenants of public sector landlords. Midlothian Council has established a framework that brings together the key agencies. This ensures that when considering any application for an ASBO, all other methods of support and intervention have been considered first. The pursuance of an Antisocial Behaviour Order involves the presentation of evidence of incidents involving antisocial behaviour and/or criminal behaviour. Evidence of intervention methods already attempted by the agencies involved are also required.
