Standard licence conditions for events

It is the duty of the licence holder to comply with the conditions of this Public Entertainment Licence and in particular to co-operate with Midlothian Council and other relevant statutory bodies.

Licence conditions

  1. Licence availability:
    A copy of the Public Entertainment licence to be available at the event and made available upon request.
  2. Safety Advisory Group:
    The Licence holder will engage as required with the Midlothian Safety Advisory Group, provide a documented Event Safety Management Plan and attend meetings when required.
  3. Insurance:
    The Licence holder shall ensure that they are covered by an adequate policy of Third Party Liability Insurance, to a minimum of £5 million, with a reputable company. An up-to-date certificate shall, upon request, be available for inspection.
  4. Inspection and documentation:
    The licence holder must permit any Police Officer or authorised Official of the Local Authority access to the event premises at any reasonable time for the purpose of inspecting and examining the same; and shall produce, upon request relevant safety certificates, signed by an independent engineer for amusement devices, or other relevant event, venue or entertainment related documentation.
  5. Site maintenance:
    The licence holder shall ensure that the licensed area is maintained clean and in a good state of repair.
  6. Health and safety:
    A suitable and sufficient assessment of the risks to health and safety of employed persons and persons not in their employment, in connection with their activities, must be carried out and documented. The licence holder shall produce this risk assessment and make it immediately available upon request to inspecting officers of the Local Authority.
  7. Capacity management:
    The licence holder will ensure that at all times an adequate system of monitoring and controlling numbers of those permitted entry is in place and that the stated licensed capacity is not exceeded.
  8. General fire precautions:
    The licence holder shall ensure that a suitable and sufficient fire safety risk assessment is carried out and reviewed as necessary in accordance with the Fire (Scotland) Act 2005 and associated regulations. Any significant findings and required control measures shall be implemented and maintained.
    All staff, stewards, and relevant persons shall receive suitable instruction and training in fire safety procedures, evacuation arrangements, raising the alarm, and the use of firefighting equipment.
    Adequate arrangements shall be in place for the evacuation and safety of disabled persons and other persons requiring assistance.
  9. Electrical safety:
    The licence holder must ensure that all electrical installations are installed, tested and maintained in accordance with the provisions of the current requirements for Electrical Installations: IET Wiring Regulations (BS 7671). Inspection Certificates shall be kept at the premises and made available for inspecting officers.
    All electrical work must be carried out by a competent person as defined in the Electricity at Work Regulations 1989 and are members of an organisation such as the National Inspection Council for Electrical Installation Contracting (NICEIC) or the Electrical Contractors Association (ECA).
    All outdoor electrical systems and equipment must be provided with appropriate and adequate residual current protection devices between any amplification or ancillary lighting system and the electricity supply.
    The licence holder shall produce electrical testing certificates for all portable electrical appliances and will make them available to inspecting officers upon request. All persons providing their own electrical equipment within the premises must certify that such equipment has been similarly tested and meets the requirements of any British Standard relevant to its use.
  10. Gas safety:
    The licence holder shall ensure that all gas appliances and installations at the premises are maintained and inspected for safety at intervals not exceeding 12 months by a Gas Safe Registered engineer. The Inspection Certificate shall be kept at the premises and made available for inspecting officers.
  11. First aid:
    Appropriate first aid and medical provision must be in place, and licence holders should ensure their event plan contains specific medical information, including plans for patient transfer, if required.
  12. Waste management:
    The licence holder shall ensure that they have suitable waste disposal arrangements in place.
    There must be sufficient, suitable refuse collection receptacles provided within all areas of the event for use by the public and attendees.
    The site must be left in a neat and tidy condition at close of each day and before leaving the site at the end of the event.
  13. Toilets:
    A suitable number of toilets shall be available for the number of people who will attend any public event. The number of toilets shall be in line with event guidance. The toilets shall be serviced on a regular basis throughout the event to ensure they are kept in a clean and hygienic condition.
  14. Water supply:
    A sufficient and potable water supply must be freely available, both in any living accommodation and at any food stalls to ensure compliance with the Food Hygiene (Scotland) Regulations 2006.
  15. Responsible contact:
    A point of contact, including mobile telephone number of a responsible person who will be present during the duration of the event shall be detailed on the event plan or provided to the Local Authority in advance.
  16. Site movements:
    When moving on and off the site at the start and end of the period, respectively, as little disturbance is caused to residents as possible by restricting movements to between the hours of 8am and 8pm.
  17. Animals at events:
    Where Animals feature as Entertainment at a Public Event, the applicant must adhere to guidance given in the Access to Farm Industry Code of Practice ‘Preventing or controlling ill health from Animal Contact at Visitor Attractions’ – Code of Practice | Access To Farms.
  18. Notification of changes:
    The Licence holder must notify the Licensing Authority in writing within 28 days of any change from the information provided in the original licence application.
